The following Terms and Conditions apply to Growing Spaces® Products and Services.  At the time of purchase, you will be asked to review and sign a Product, Shipping, and Installation Agreement with these terms.  Please review carefully and contact us if you have any questions.

Please refer to our Website Terms and Conditions for the use of this website (growingspaces.com) as well as all transactions conducted through this site.

WARRANTY

The Growing Dome® includes a five (5) year warranty from Growing Spaces against structural failure of the Dome’s struts and hubs. The Purchaser must follow all recommended maintenance procedures outlined in the Growing Dome® Owner’s Manual to maintain warranty coverage. The foundation is not covered. Polycarbonate glazing is warrantied by the manufacturer against hail damage and yellowing (pro-rated for ten years). Altering the Dome’s design, or use for non-greenhouse purposes, voids all warranties unless such alternative use is approved in advance in writing by Growing Spaces. All applicable manufacturer warranties for components will be passed through to the Purchaser. Purchaser is responsible for registering components with manufacturers and filing their own warranty claims. Growing Spaces can provide support as needed. Warranties are not transferable to subsequent owners. However, Growing Spaces® will continue to offer customer service, support, and maintenance services to verified secondary owners.

Under no circumstances shall Growing Spaces be liable to Purchaser for damages exceeding the total amount paid by Purchaser under this Agreement. Growing Spaces shall not be liable for incidental, indirect, special, or consequential damages arising out of this Agreement.

PAYMENT

Purchasers planning for permitting or funding processes may secure current pricing with a 10% deposit on the dome kit. This pricing is valid provided that shipment is completed within four (4) months of the deposit date. The initial 10% deposit is fully refundable at any time prior to the Purchaser submitting the additional 40% production deposit.

If delivery does not occur within the four-month period:

  • The 10% deposit may be refunded, or applied to an updated price if mutually agreed.
  • If a 50% deposit has been made, the order may be subject to storage fees and restocking charges, or the final payment may be adjusted to reflect current pricing upon mutual agreement.

Purchasers who do not require permits or do not wish to pursue permitting may bypass the 10% deposit step and proceed directly with a 50% deposit to initiate manufacturing. This will place the order into the production queue and schedule it for shipment accordingly. A production confirmation will be issued once the deposit is received.

The remaining 50% of the dome kit cost is due one week prior to the scheduled shipment date.

We accept ACH/e-check, wire, debit, major credit cards, and Affirm monthly payments for eligible purchases.

Using Affirm

  • The deposit model does not apply when using affirm. Your order enters production only after full Affirm approval for the entire order. If approval is not granted or is withdrawn prior to release, you may switch to a non-Affirm method and follow our standard deposit milestones.
  • Affirm is a third-party lender. Your application, credit decision, APR/fees, and repayment are between you and Affirm.
  • Paid in full requirement. When you select Affirm at checkout, your entire cart total must be approved and paid through Affirm. We do not accept partial payments, deposits, or split tenders when using Affirm.
  • Down payment & schedule. Affirm may require a down payment at checkout and limit the methods in which the down payment is paid (such as debit card only); the remainder is financed with Affirm on the schedule you accept.
  • Order release. We will release your order into our workflow only after Affirm approval for the full amount and authorization is received.
  • Loan issues (payments, fees, delinquency, credit reporting) are handled directly with Affirm and do not pause our production/shipping once an Affirm paid order has been released.
  • When you choose Affirm, you share information directly with Affirm under their privacy policy; we do not receive your full credit details.

CANCELLATION POLICY

Orders cancelled at any time are subject to a 5% restocking and processing fee, deducted from any refund due.

If the order is cancelled within 20 business days of the scheduled shipment date, an additional 5% of the full order value will be withheld (total 10%). The remaining balance will be refunded within 90 days of cancellation to allow for material reconciliation, scheduling updates, and refund processing.

Cancellations are not permitted for custom orders, defined as changes to structural design, size, or non-standard component substitutions. In practice, this means that the production deposit for a custom order will be forfeited upon cancellation. Growing Spaces will not enforce delivery for unpaid custom orders.

When using Affirm:
Our normal change/cancellation rules apply. If you cancel an Affirm-financed order, any eligible refund of amounts already captured will be routed back to Affirm; Affirm will adjust your loan per its terms. If you change your order (options, pricing, add/remove items), we will:

  • attempt an Affirm amount adjustment (subject to Affirm approval), or
  • process the difference via a non-Affirm payment method before the order proceeds.

SHIPPING & DELIVERY

Growing Spaces will determine the method and timing of shipment. Kits are shipped on the next available shipping date, using qualified carriers with cost and schedule considerations. Lead times typically vary from 4 to 8 weeks depending on the time of year. Purchasers will be notified when their order is assigned a production and shipment date. Growing Spaces will provide a tracking number once the items have left our facility. Growing Spaces requests that the carrier provides a 24 hour call ahead to schedule a delivery window.

Shipping costs are non-refundable. Risk of loss or damage passes to the shipping carrier upon pickup. While Growing Spaces does not insure shipments, it will work informally with the shipper and assist the Purchaser in filing damage claims. Purchaser must report any damage immediately upon delivery, note damages on freight documents, and provide photographic evidence.

Growing Spaces may ship up to five (5) business days before the agreed-upon shipment date. All shipment changes or postponements may be subject to change fees. Carrier details and tracking information will be provided when available.

Purchaser acknowledges that Growing Dome® kits are shipped in large, heavy crates typically delivered via full-size tractor-trailer or large box trucks. It is the Purchaser’s responsibility to ensure the delivery location can safely and reasonably accommodate such vehicles. Purchaser must verify that their site has sufficient space, clearances (height, width, and turning radius), and road conditions suitable for large truck access.

If access limitations exist or special arrangements (e.g., smaller trucks, liftgate service, forklift, or offloading assistance) are required, the Purchaser must notify Growing Spaces prior to shipment. Additional charges related to special handling or redelivery due to undisclosed or unforeseen site conditions will be the Purchaser’s responsibility.

Lead times, shipping coordination, and risk transfer at pickup/delivery are unchanged for financed orders. Financing does not alter inspection/claim responsibilities.

ERRORS, INACCURACIES, AND OMISSIONS

Information on our Sites may contain typographical errors, inaccuracies, or omissions that relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Sites is inaccurate at any time without prior notice (including after you have submitted your order). In the event we make a change to or cancel an order, we will attempt to notify you by contacting the email, phone number and/or billing address provided at the time the order was made.

PERMITTING SUPPORT AND DOCUMENT ACCESS

Stamped engineered plans, foundation drawings, and selected Owner’s Documents pertaining to site preparation and foundation options will be provided upon receipt of the initial 10% deposit and this signed agreement. These materials support permitting and preparation processes and may be tailored to your local regulatory authority requirements.Purchaser acknowledges responsibility for obtaining all local permits, inspections, and complying with applicable laws, regulations, and homeowner association requirements related to the installation and use of the Growing Dome®. Growing Spaces will provide permitting support documentation, but all local compliance is solely Purchaser’s responsibility.

INVENTORY AVAILABILITY

The inventory availability information presented at the time of purchase is the most current inventory we have, but is subject to change. If for some reason a component of a Growing Dome® kit, package, or upgrade is not available at the time of shipment, we will notify you via a phone call that the item has been back-ordered. You will also receive a parts checklist with your crate that will indicate that this item or items have been back-ordered. We will ship the item to you free of charge as soon as we receive the item in stock and will do our best to expedite the process.

INTELLECTUAL PROPERTY AND BRAND USE

Growing Spaces retains full ownership of all proprietary and registered designs, documentation, and trademarks associated with the Growing Dome®. Protected materials include, but are not limited to, engineered plans, assembly instructions, the Owner’s Manual, branding assets, and any supporting materials provided before or after shipment. These materials may not be copied, transferred, or reused without prior written permission. This includes transfer to a secondary buyer in the case of resale.

If the Purchaser resells their Growing Dome®, the new buyer must register with Growing Spaces and sign a non-disclosure agreement to receive replacement documentation and support. The original owner may not provide Growing Spaces’ proprietary materials directly to any third party. Growing Spaces provides replacement materials, including the Owner’s Manual, to verified resale buyers at no additional charge.

While not required, Growing Spaces encourages Purchasers to refer to “Growing Dome®” and “Growing Spaces®” when publicly sharing about their greenhouse experience (e.g., blogs, social media, publications). Tagging or linking to official Growing Spaces® content is appreciated where appropriate. Please contact us if you’d like official logos or language for signage or promotional use. As a small business, Growing Spaces® thrives on word of mouth and community support. We deeply appreciate your help in spreading the word about your Growing Dome® experience.

INSTALLATION ELIGIBILITY

Installation services are available in select regions and are subject to crew availability. Purchasers must have a prepared and approved foundation before installation can be scheduled. Growing Spaces reserves the right to delay or decline installation if site access, weather, or safety conditions are inadequate.

SCOPE OF INSTALLATION SERVICES

Growing Spaces offers various installation services for the Growing Dome® greenhouse kit purchased separately by Purchaser. These services include:

  • Full Crew Installation: A certified crew assembles the dome structure and standard components.
  • Supervisor Only Installation: A certified supervisor assists and guides the Purchaser and/or their hired crew.
  • Supervisor Plus One Installation: A certified supervisor and one installer assist and guide the Purchaser and/or their hired crew.

Installation services do not include foundation preparation, utilities, or site work unless otherwise specified in writing.

INSTALLATION PAYMENTS

A 50% deposit is required to schedule installation. The remaining 50% is due within two weeks of installation completion. Payment methods and deadlines will be confirmed in the installation invoice. The final invoice will be issued upon project completion confirmation by Growing Spaces.

Installation costs will be provided to the Purchaser in a separate written quote or invoice. This agreement governs the terms of service, not pricing specifics.

POSTPONEMENT & CANCELLATION OF INSTALLATION SERVICES

Changes to installation dates requested within 20 business days of the scheduled date may incur a rescheduling fee up to 20% of the installation quote. Cancellations within 20 business days of the scheduled date may result in forfeiture of up to 50% of the installation labor and travel portion of the quote.

INSTALLATION INCLUDES & EXCLUDES

These apply to all installation types unless otherwise agreed in writing.

Included: Dome structure assembly and erection, doors, standard vents, solar devices, insulation, flashing, anchoring, polycarbonate glazing, trim, tape, above ground pond, fans, shade cloth, and interior or exterior raised planter beds offered on the Growing Spaces website at additional cost. Custom interior design work and installation is available by quote.

OUT-OF-SCOPE SERVICES AND THIRD-PARTY WORK

Customer acknowledges that Growing Spaces’ installation scope is limited to the services expressly included in this Installation Agreement and any written addenda issued by Growing Spaces. The following services are not included and are not provided, coordinated, supervised, or warranted by Growing Spaces: site preparation (grading, leveling, excavation, drainage), gravel pads or foundations, trenching or utility work, plumbing, electrical, HVAC/gas, permitting/inspections, engineering or structural modifications, landscaping, irrigation systems, and any other construction activity not expressly included in this Agreement.

  • Independent installers for Growing Spaces scope. Growing Spaces may perform installation using trained and experienced independent installer businesses approved to perform Growing Spaces’ installation scope and work on Growing Domes. As of the Agreement Date, current approved independent installers include:
    • Willis Contracting LLC (Austin Willis)
    • Geckos Remodeling (Steven Stouffer)

These installers are independent businesses and are not employees of Growing Spaces.

  • Out-of-scope work (separate contract; no endorsement). If Customer engages any contractor for out-of-scope services, that work is governed by a separate agreement solely between Customer and that contractor, and is paid directly to that contractor. Growing Spaces is not responsible for the cost, quality, scheduling, permits, code compliance, warranty, delays, or outcomes of any out-of-scope or third-party work. Any names provided are for convenience only and do not constitute a recommendation or endorsement. Availability varies and Customer is responsible for selection and oversight. For clarity, Customer may separately engage Fresh Digs LLC (Sarah Avery) for site preparation services (such as dirt work, leveling, and gravel pads or concrete piers). Customer may also separately engage Willis Contracting LLC (Austin Willis) and Geckos Remodeling (Steven Stouffer) for out-of-scope services under their independent businesses. Any such out-of-scope work is not performed by Growing Spaces and is not within Growing Spaces’ installation or maintenance scope, nor warranty coverage.

INSTALLATION OPTIONS AND CREW SIZING

The following table summarizes crew sizes and helper expectations based on dome size and selected installation type. Estimated installation time depends on dome size and chosen service level:

Purchasers must provide the recommended number and skill level of helpers. Supervisors will guide completion but cannot guarantee final assembly if site or team readiness is insufficient.

INSTALLER TRAVEL & LODGING

Travel, lodging, and meals must be coordinated with your Installation Coordinator. If the site is over 50 miles from the nearest crew, the quote will include travel, meals, and accommodations. Trips under 250 miles include mileage, per diem, and lodging. Trips over 250 miles may include airfare, baggage, parking, and travel time. Growing Spaces makes every effort to align travel expenses with your specific location and uses the above mileage cutoffs as guidelines only, application may vary by dome and crew size.

PREPARING FOR INSTALLATION

Purchasers must ensure all required Owner Supplied Items are at the build site when Certified Installers arrive. Details of the required Owner Supplied Items can be found in the Growing Dome® Owner’s Documents, which should be reviewed prior to scheduling installation. 33’ and 42’ domes require the Purchaser to provide ladders with stand-offs and scaffolding with locking wheels. The site must be within 2 inches of level (or 1/4 inch for concrete foundations), verified with a transit or laser level. Permits, if required, must be secured and provided to Growing Spaces prior to crew deployment or purchaser accepts responsibility for potential penalties from their local permitting authority. If the site is unprepared upon arrival, the Purchaser agrees to pay hourly rates (or 1.5x for overtime), or reschedule with additional travel costs. Further preparation guidance is provided in the Owner’s Documents and should be followed to ensure installation readiness.

Purchaser is responsible for ensuring a safe and accessible environment for the installation crew. This includes but is not limited to clear access routes, proper safety equipment, and adherence to local building and safety regulations. Failure to provide these conditions may result in delays and additional charges.

INSTALLATION WORKMANSHIP ASSURANCE

For Full Crew Installation only: The following terms begin on the date of installation completion as confirmed by Growing Spaces:

  • Seam Workmanship Standard (30 Days). Covers major seam leaks caused by missing, cut, or grossly misapplied seam tape or panel misfit that result in either a continuous stream or repetitive dripping greater than one drop every five seconds for five minutes from the same location, with doors and windows closed under typical weather, and that cannot be reasonably resolved with the provided patching tape per the Owner’s Manual. This standard targets true seam or tape failures and does not guarantee a watertight greenhouse.

Exclusions: Normal condensation inherent to greenhouse environments; wind-driven rain through designed openings (vents, doors, fan hoods); splash-back from grade; penetrations or alterations not installed by Growing Spaces or its installer; pressure-washing or other artificial water pressure; and irrigation overspray. Seam tape naturally weathers over time and is expected to be patched as needed and fully re-taped approximately every 5–8 years as part of normal maintenance.

  • 3-Month Assembly / Fit & Finish Standard. Covers workmanship on assembly, fit, and finish (including inside-dome add-ons), provided the dome is maintained per the Owner’s Manual.
  • Support & Coordination. Growing Spaces is your first point of contact. Submit claims in writing with dated photos or video showing location, approximate rate, and weather conditions. If a condition meets the workmanship threshold above, Growing Spaces will coordinate a seasonally appropriate correction window; correction may be performed by Growing Spaces or by the original installer under our direction. We may, at our discretion, provide limited materials and guidance for a remote remedy or arrange an on-site visit. Remedies may include resealing/retaping, providing materials with guidance, or a proportional refund of the installation labor fee.
  • Patch Materials. Surplus seam tape is typically left after installation for minor spot patches. Additional materials, if any, are provided at Growing Spaces’ discretion and current pricing.

Any issues first noticed after the applicable assurance window are the Purchaser’s responsibility.

LIMITATIONS

Installation services do not include modifications or non-standard features unless expressly documented. Additional labor or return visits due to incomplete foundations, site inaccessibility, or miscommunications may incur extra charges.

FORCE MAJEURE

Neither Growing Spaces nor the Purchaser shall be liable for any delays, postponements, or inability to fulfill obligations under this Agreement due to circumstances beyond reasonable control, including natural disasters, pandemics, labor strikes, governmental restrictions, or supply chain disruptions. Both parties agree to communicate promptly in such events and reschedule services as soon as feasible.

INDEMNIFICATION

Each party agrees to indemnify and hold harmless the other, including their employees, subcontractors, and agents, from any third-party claims, damages, or liabilities arising from their own negligence, misconduct, or breach of this agreement.

This clause applies only to direct actions or omissions by the indemnifying party or their personnel. It does not extend to general construction risks, foundation issues, or third-party contractors not under the direct supervision of Growing Spaces.

ENTIRE AGREEMENT; GOVERNING LAW

This Agreement represents the entire understanding between the parties with respect to the purchase of a Growing Dome®. It may not be modified except in writing signed by both parties.

This Agreement shall be governed by the laws of the State of Colorado. Any disputes shall be subject to binding arbitration under the rules of the American Arbitration Association.

Should disputes arise from or relate to this Agreement, both parties agree to first attempt resolution through direct negotiation within 30 days. If unresolved, disputes will proceed to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, held in Archuleta County, Colorado.

Due to the great amount of variables (materials, logistics, etc.) all dates must remain flexible and are not guaranteed under any circumstances.
